Terms and Conditions

These Terms and Conditions (“Terms”) govern the relationship between Nexus Air Service (“we”, “us”, or “our”) and the customer (“you”, “your”). By booking a site survey, installation, repair, or maintenance service with us, you agree to be bound by these Terms.

1. General

1.1 Nexus Air Service is the trading name of Nexus Air Service, company number 17043765, registered at 5 Brayford Square, London, England, E1 0SG.

1.2 These Terms apply to all quotations, bookings, and contracts for the supply of goods and services by us.

2. Quotations and Bookings

2.1 All quotations are provided based on a site assessment. We ensure your system is matched to the unique layout and environment of your space.

2.2 Quotations are valid for 30 days from the date of issue, unless otherwise stated in writing.

2.3 A contract is only formed once you have confirmed your acceptance of our quote and we have scheduled your service date.

3. Fees and Payment

3.1 Fixed-Rate Repairs: Diagnostic visits and repairs are charged at a fixed rate, which will be communicated to you prior to the engineer's visit.

3.2 Deposits: For larger installations, a deposit may be required before work commences. This will be specified in your quotation.

3.3 Payment Terms: Payment is due immediately upon completion of the work unless a prior credit or maintenance account has been established.

3.4 Late Payments: We reserve the right to charge interest on overdue accounts at a rate of 8% above the Bank of England base rate.

4. Cancellations and Rescheduling

4.1 If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice.

4.2 Failure to provide adequate notice or failing to grant our engineers access to the property at the agreed time may result in a "failed call-out" fee to cover our operational costs.

5. Warranty and Workmanship

5.1 Installation Warranty: All new installations come with a manufacturer’s warranty on parts (typically from brands like Daikin, Mitsubishi, Fujitsu, Toshiba, or Samsung). This is subject to the system being maintained annually by a certified engineer.

5.2 Labour Warranty: We provide a [12-month] warranty on our workmanship. This does not cover faults caused by external factors, misuse, or lack of routine maintenance.

5.3 Repairs: Repairs are guaranteed for the specific fault addressed for a period of [90 days].

6. Access and Property

6.1 You agree to provide our engineers with safe and clear access to the property and the HVAC equipment.

6.2 While we take every precaution to protect your property (using floor coverings and industrial vacuums), we are not liable for pre-existing structural defects or issues that arise from necessary drilling or fixing into aged or fragile surfaces.

7. F-Gas Compliance

7.1 All our engineers are F-Gas Category 1 certified.

7.2 We are legally required to log and report the handling of refrigerants. You agree to allow us to maintain these records as required by UK environmental law.

8. Liability

8.1 We maintain comprehensive Public Liability insurance.

8.2 We are not liable for any indirect or consequential loss, loss of profit, or damage caused by system downtime, particularly in commercial or critical environments (e.g., server rooms), unless a specific Service Level Agreement (SLA) is in place.

8.3 Nothing in these Terms limits our liability for death or personal injury caused by our negligence.

9. PIV Unit Installations

9.1 Our PIV systems are an effective solution for condensation and mould. However, the effectiveness of the system is dependent on the property being operated in accordance with our guidance (e.g., keeping internal doors slightly ajar to allow airflow).

10. Governance

10.1 These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
